The Decree Law No. 554 pertaining to the protection of Designs has entered into force in Turkey on 27th June 1995. The new Law has brought the following modern provisions: Registered design system, non-examination system as to substance, protection term of 5 years which can be extended up to 25 years by 4 times renewal, publication of designs, deferment of publication (for designs which are quickly out of fashion like in textile), multiple application, opposition by third parties, compensation of damages against infringement, establishment of special courts. MINIMUM REQUIREMENTS 15 copies of the representation (8x8 cm) (for 3 dimensional designs, top, bottom and side vews must be given). The written description of the design, a receipt for payment of fees and a petition for application containing information on: Applicants name, nationality, address, etc., Priority applications country, date and number (if any), The designers name, nationality, address, etc., and in case the applicant is not the designer, a declaration concerning the acquirement of the right to apply for an industrial design. PROCEDURE The first step is the examination of the application as to the compliance with the formal requirements. If there are no deficiencies, the application is given a filing number and date. Otherwise, the applicant is requested to remedy the deficiencies. If the applicant remedies the deficiencies within the prescribed time limit the application is given a filing date and number, which is either the date on which the deficient application was originally filed or the date on which the deficiencies are remedied, depending on the deficiency to be remedied. If the applicant does not remedy the deficiencies the application is deemed not made. The second step is the registration in the Design Register and the publication in the Design Bulletin. Before publication, the publication fee and in case of a multiple application, the additional application fees are to be paid within the time limits, if not the application is deemed void ab initio. If there is no opposition by third parties, the applicant is requested to pay the sealing fee and the design title is issued. OPPOSITION After the publication in the Turkish Design Bulletin, third parties have 6 months for opposition purposes. In case the opposition is not considered as well founded the design application is granted. In case the opposition is considered as well founded the examiner may request written observation by the parties involved as often as necessary. At the end the design may be maintained or invalidated, the invalidation shall also be published in the design bulletin.
